A.2 PLACING AN ORDER

1. Set out below is a summary of the steps which you must follow in order to conclude a legally binding contract with us:

Step 1 :

Upon your filling in an available user name and password and provided that you agree unconditionally to these terms and conditions, you will be given the opportunity at the end of this document to click on the [first] “YES” button.  Immediately thereafter you are allowed access to the web page and select your product(s) as displayed on screen. Upon clicking the cursor on the product you shall find information on prices together with a description of the products and services which are available, and an explanation of promotional offers, if any associated with the product and methods of payment.

Step 2 :

Upon your selecting the product(s), you will be given the opportunity to check it in your cart and to then submit an order to us by clicking on the “Order” button which appears at the end of the form. When you place an order to purchase a product from our website, you will receive an e-mail confirming receipt of your order and containing the details of your order (the “order confirmation e-mail”). The order confirmation e-mail is an acknowledgement that we have received your order, but it does not confirm acceptance of your offer to buy the product(s) ordered.

If you do not wish to submit an order to us, you should click on the “Escape” button and you will return to our home page.

Step 3 :

We shall only accept your offer, and conclude the contract of sale for a product ordered by you, when the product shall be dispatched to you and an e-mail confirmation is sent to you that the product has been dispatched to you (the “dispatch confirmation e-mail”).

If your order is dispatched in more than one package, you may receive a separate dispatch confirmation e-mail for each package, and each dispatch confirmation e-mail and corresponding dispatch will conclude a separate contract of sale between you and the seller of the product(s) specified in that dispatch confirmation e-mail.

2. Please note that while we guarantee to send to you a e-mail notification of every valid order we receive from you and dispatch made by us, you will understand that we cannot equally guarantee that the notification we send will be received by you, nor that, if it is received by you, it is legible and uncorrupted. It is your responsibility to contact us if you should have any trouble reading the message, any doubts or queries in regard to the same.

3. There are some situations where we cannot accept an order, and in the order form, you will be asked to identify if any of these are applicable to you by either clicking on a “YES” or “NO” box. You will ensure that your responses are not misleading or inaccurate, and accordingly you acknowledge that we are reliant upon you to complete the order form accurately.

B.1 ELIGIBILITY CRITERIA

1. Use of this website is available only to persons who can form legally binding contracts under applicable law. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872, including un-discharged insolvents etc. are not eligible to use the Website.

2. If your age is below 18 years you are prohibited to use/purchase/contract from/with this website. Such persons are also prohibited from purchasing any material which is for adult consumption the sale or purchase of which to/by minors are strictly prohibited.

3. Those who choose to access this website from outside India are responsible for compliance with local laws if and to the extent local laws are applicable. FastDeals will deliver the products only within India and will not be liable for any claims relating to any products ordered from outside India.

B.2 WARRANTIES & LIMITATION OF LAIBILITIES

FastDeals has taken every care in the preparation of the contents of this website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described. We have tried to ensure that material included on the website is correct, reputable and of high quality, we cannot accept responsibility if this is not the case. FastDeals will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the website.

2. Any product you buy from our website is completely at your discretion and you accept that you place the order only after thoroughly enquiring about the product and being completely acquainted about the product, its features, characteristics, usage etc. The weights, dimensions and volume/capacities given are approximate only. Packaging may vary from that shown. FastDeals hereby disclaims any guarantees of exactness as to the finish and appearance of the product(s) as ordered by the user.

6. FastDeals is not liable for any kind of damages or losses whatsoever suffered by you due to the use of the product(s).

B.3 PRICING AND TAXES

Pricing of each product is as displayed on the website and may vary from time to time but once the order is confirmed the price is fixed and will only be subject to taxes or delivery charges, where applicable. All prices are inclusive of GST unless stated otherwise. You shall be responsible for payment of all fees/costs/charges associated with the purchase of products from the website and you agree to bear any and all applicable taxes/GST, cesses etc levied thereupon.

B.4 PAYMENTS

1. All payments shall be made through banking channels only i.e. internet banking, credit/debit cards, UPI, only. Therefore, refunds, if any, will also be credited to the same bank account from where the money was originally remitted via the same payment mode that you had used to make the transaction.

2. You agree, understand and confirm that the credit debit card details or other financial details provided by you for availing of services on the website will be correct and accurate and you shall not use a credit/debit card or financial facility which is not lawfully owned or obtained by you.

3. You understand that any financial information submitted by you is directly received by the acquiring bank through appropriate payment gateways/channels and is not stored in any manner by FastDeals.

4. FastDeals will not be liable for any credit/debit card fraud. The liability for use of a card fraudulently will be exclusively on you. All information collected by us shall be governed as per our Privacy Policy as below.

B.5 DELIVERY SCHEDULE

1. The time taken for delivery tends to vary according to the destination; however, we make our best efforts to ensure that the order is delivered on time and in perfect condition. A tentative delivery date/time will be given along with the order confirmation e-mail. The exact delivery date shall be provided as soon as your order is ready for dispatch. We also ensure that the delivery is made to the recipient and thus require the government issued photo-identity proof for verification. In case you want express delivery or special delivery, the same may at our option, be organised upon payment of special delivery charges.

2. In the unlikely event that we fail to deliver your order within the stipulated period, we shall cancel the order and notify you regarding the same. In such cases, the refund will be made directly to your account via the same mode of transaction through which the payment was made.

B.6 COMMUNICATIONS

1. You agree that we may communicate with you via e-mail and/or SMS sent to the details as mentioned by you in your membership form while creating your username and password. You unconditionally agree that you shall not challenge the receipt of such communication or information sent to you at your mentioned email address and phone number.

2. We will gather the information which you give to us in the order form to provide you with our on-line ordering service. By giving us this information, you consent to our use of it in order to process your order. We may even contact you for special offers, discounts or any promotional event.

3. We may also use the information for marketing to you our own products/services of a similar nature to those you are interested in. If you do not wish to have your details used in this way, please click “NO” on the relevant button at the end of the order form.

B.7 TITLE

Title to the product(s) ordered remains with us until such time as payment is cleared and funds have been received by us.

B.8 CANCELLATION OF ORDERS

1. You can cancel your order for a product at no cost any time before the same is dispatched to you and we send the dispatch confirmation e-mail relating to that product. Once the cancellation request is received, we will cancel the order and initiate the process of refunding the entire amount, if any, to your account via the same payment mode that you had used to make the transaction.

2. However, in the event the product has been dispatched and you intend to cancel your order, then you shall be liable for shipping/courier charges and the same shall be deducted from the amount paid by you and only the balance amount will be refunded.

3. This right of cancellation shall not apply, in any event, in the following circumstances:

(a) To services if performance of the contract has begun with respect to your order placed

(b) To any product made to your specification, customized or personalized at your request.

4. The customer agrees not to dispute the decision made by FastDeals and accept FastDeals’ decision regarding the cancellation.

B.9 RETURNS POLICY

1. FastDeals is committed to ensuring full customer satisfaction with respect to the products available on our website. However, if you are not happy with the product, you can choose to return the order by calling our customer support at 09051011811 or writing to us at [email protected] within 3 days of the order delivery.

2. Returns will be accepted only where a defective/damaged product has been delivered to you. You shall return such product unused and unaltered and in the same condition as you received it, in its original packaging, along with the tax invoice and guarantee card in the package, if any for the return process. Without compliance of the above, returns will not be processed by our shipping agents.

3. We shall initiate the process of refunding the full amount within 48 hours of us receiving the returned product. Once the refund process has been initiated, the amount will be directly refunded to your account via the same mode through which the transaction was made within 7 working days thereafter.

Note: We shall not entertain any request after 3 days from the date of delivery of the order.

B.10 EXCHANGE POLICY

We regret to inform that exchange of products is not possible for the products bought from our website. However customer can choose to return the product as mentioned earlier.

B.11 PRIVACY POLICY

1. We ensure you that FastDeals upholds complete confidentiality of the details that you have shared with us and will not share it with any third party. We may ask for certain details such as name; date of birth; e-mail address; residential address; contact number etc for registration purposes or for giving feedback, contests, sending newsletters and/or placing an order.

2. Also, for security purposes, we not accept any financial information on our servers. All information entered by the customer is directly received through the payment gateways and are transmitted to their respective banks’ servers. All this is done through industry standard encryption protocols. The payments on our website are processed by a third party who has signed a non-disclosure agreement with us and therefore, is not allowed to share any personal information of the customers.

FastDeals and its suppliers/licensors as the case may be reserves all intellectual property rights in all text, programs, products, processes, technology, content and other materials, which appear on this website. The FastDeals name and logo and all related product and service names, design marks and slogans are the trademarks or service marks of FastDeals. All other marks are the property of their respective companies.

2. Access to this website does not authorize anyone to use any name, logo or mark in any manner. All materials, including images, text, illustrations, designs, icons, photographs, programs, music clips or downloads, video clips and written and other materials that are part of this website are intended solely for personal and non-commercial use. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of FastDeals. You may not modify, distribute or re-post something on this website for any purpose.

B13 FEEDBACK, REVIEW & INAPPROPRIATE COMMENTS

C.1 FORCE MAJURE

Although we take all reasonable care and caution while providing you the services, there can be certain situations which may prevent us from performing our obligations. We are not liable for any delay in the performance or non-performance of any of our obligations hereunder and shall not be liable for any loss or damages caused thereby where the same is occasioned by any cause whatsoever that is beyond our control including but not limited to an act of god, war, civil disturbance, governmental or parliamentary restrictions, prohibitions or enactments’ of any kind, import or export regulations, exchange control regulations or accident or non-availability/ delay in transport.

C.2 TERMINATION

1. These terms of use are effective unless and until terminated by either you or FastDeals. You may terminate these terms of use at any time by discontinuing any further use of this website whereas, FastDeals may terminate these terms of use at any time and may do so immediately without notice, and accordingly deny you access to this website. Such termination will be without any liability upon FastDeals.

2. Any such termination of these terms of use shall not cancel your obligation to pay for the product(s) already ordered from the website or affect any liability against you that may have arisen under the terms of use.

C.3 INDEMNITY

1. You agree not to post or transfer to our website (nor include in any message) any material which is obscene, misleading, inaccurate, defamatory, illegal, in breach of any copyright or other intellectual property right, or damaging to data, software or the performance of our or any other parties’ computer system.

2. You agree to indemnify us in respect of any liabilities, losses, expenses, or other costs whatsoever incurred as a result of a breach of your obligation under this condition, including, but not limited to, any claims made against us by any third party.

In the event the modified terms of use is not acceptable to you, you should discontinue using the service. However, if you continue to use the service you shall be deemed to have agreed to accept and abide by the modified terms of use.

C.5 INTERPRETATION

In case any clause or part of these terms of use have more than one interpretation, then the one which is in harmony with the ethos of the trade and commerce shall be given precedence over the other.

C.6 GOVERNING LAW

These terms of use shall be construed in accordance with the applicable laws of India. The Courts at Kolkata shall have exclusive jurisdiction in any proceedings arising out of this agreement.

C.7 SEVEREBILITY

If any part of these terms of use is determined to be invalid or unenforceable pursuant to applicable law, then the same shall be severed from the terms of use and will not affect the validity and enforceability of any remaining terms of use as between you and us.
